Mr A Popko v The Dolphin and others: 2503485/2019
JUDGMENT
Upon the Tribunal being satisfied that it was appropriate to proceed in the absence of those parties who were not represented and after considering the filed documents and hearing the parties, the Tribunal finds that[1]There had been successive transfers of undertaking so that the claimant had completed more than two years continuous service and is therefore entitled to bring a complaint that he was unfairly dismissed[2]The claimant’s continuous employment ended on 20 September, 2018[3]At that time the claimant was employed by the third respondent and she is the Case Numbers: 2503485/2019 correct respondent in respect of all of the claimant’s complaints[4]The complaints against all of the other named respondents are dismissed as they are trading names and/or were not the claimant’s employer at the times relevant to these proceedings[5]It be noted that, save as is set out above, the Tribunal was not in a position to and has not given any indication as to the eventual outcome of any of the claimant’s complaints
