Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the claimant's wages.[2]The claim succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing.[3]The hearing listed on 11 March 2019 is converted to a remedy hearing.
REASONS
[1]A judgment by Employment Judge Arullendran on 12 February 2019 upheld the claim of unlawful deduction of wages.[2]The law relating to unlawful deduction of wages is in Part 2 of the Employment Rights Act 1996. The claimant worked from 5 October to 5 November 2018. She should have been paid £3333.33 gross for the month she worked, but was paid nothing. T M Garnon EMPLOYMENT JUDGE
