JUDGMENT
[1]The claimant’s complaint of breach of contract (non-payment of one months’ notice) is well-founded and the respondent is ordered to pay the claimant forthwith the sum of £1581.58 as damages for breach of contract.[2]The claimant’s complaint of unlawful deduction from wages is well-founded and the tribunal declares accordingly. The respondent is ordered to pay the claimant forthwith the following sums: -• the sum of £1421.00 representing a shortfall between the national minimum wage and the wages paid by the respondent to the claimant• the sum of £381.75 for the period 30th October to 03 November 2023• the sum of £14.99 for expenses claimed in an expenses report dated 03 November 2023 for expenses incurred between the 23 to 31 October 2023• the total sum therefore payable for unlawful deduction from wages is £1817.74.[3]The claimant’s complaint of automatic unfair dismissal, contrary to section 104 (1) (b) of the Employment Rights Act 1996 is well-founded and the respondent is ordered to pay the claimant forthwith a compensatory award (the claimant not been entitled basic award) of £1527.00.
