JUDGMENT

No response has been presented to this claim (and on the Respondent failing to attend), the Respondent is debarred from taking any further part in these proceedings under rule 21 of the Employment Tribunal Rules. Judgment for the Claimant in respect of(a) The Claimant’s claim for unlawful deductions from wages;(b) Unlawful racial harassment;(c) Unfair dismissal. On hearing the Claimant’s evidence on compensation: (a) The Claimant’s claims for unlawful deductions from wages succeeds for deductions from the Claimant’s wages from 22 October 2018 to 15 May 2019. The Respondent shall pay to the Claimant £7644.75 in respect of unlawful deductions from wages; (b) The Claimant’s claim for unlawful racial harassment under the Equality Act 2010 succeeds. The Respondent shall pay to the Claimant £9,000 in respect of compensation for injury to feelings under the Equality Act 2010. (c) The Claimant’s claim for unfair dismissal succeeds under section 104A of the Employment Rights Act 1996. The Claimant obtained further work immediately and therefore has claimed no compensatory award. He is accordingly awarded nothing under this aspect of his claim.
