JUDGMENT

[1]The first claimant Mr Mark Rose’s complaint of unfair dismissal is well founded and succeeds.[2]The second claimant Ms Caroline Robinson’s complaint of unfair dismissal is well founded and succeeds.[3]Any compensation for unfair dismissal to be awarded to either claimant shall be reduced by 25% to reflect the possibility that either claimant may have been fairly dismissed had the respondent followed a fair procedure.[4]Any compensation to be awarded to either claimant shall be reduced by a further 25% to reflect the extent to which each claimant contributed to their own dismissal by their conduct, pursuant to Sections 122(2) and 123(6) of the Employment Rights Act 1996.[5]By not later than 31 January 2025 the parties’ representatives shall inform the Employment Tribunal as to whether each claimants’ entitlement to a remedy has Case Number: 2502563/2023 2502647/2023 been agreed and settled and if not a remedy hearing with a time estimate of three hours shall be listed not later than 31 March 2025.
