Mr P Forster v Cumbria, Northumbria, Tyne and Wear NHS Foundation Trust: 2502528/2023
JUDGMENT
[1]The claimant has no reasonable prospect of establishing:a. that alleged discriminatory acts set out in Paragraphs 3.1.1 – 3.1.7 of the Draft List of Issues covering the period 2013 – 2022 were part of a course of conduct over a period orb. that it is just and equitable to extend the time limit for bringing complaints of discrimination in relation to those acts.[2]The complaints of discrimination in relation to those acts are therefore struck out under Employment Tribunal Rule 38(1)(a).[3]The application to strike out the complaint regarding David Muir in March 2023 is refused. The Tribunal will decide at the final hearing whether or not the claim was part of a continuing series of event so as to bring it within the time limits or it is just and equitable to extend the time limit for bringing this complaint of discrimination . v3 10.2.25 Case Number: 2502528/2023 Approved by: Employment AEPitt 25th August 2025 Note Reasons for the judgment were given orally at the hearing.
