JUDGMENT
The Judgment of the Employment Tribunal is as follows:[1]The claimant’s claim for unfair dismissal pursuant to section 98 of the Employment Rights Act 1996 is not well-founded and is dismissed.[2]The claimant’s claim for a redundancy payment pursuant to section 139 of the Employment Rights Act 1996 is not well-founded and is dismissed.[3]The claimant’s claim for notice pay is well-founded. The respondent is ordered to pay to the claimant notice pay in the sum of £673.08 gross, subject to any deductions of tax and national insurance the respondent may be obliged to make.[4]The claimant’s claim for the unauthorised deduction of wages is well-founded. The respondent is ordered to pay to the claimant the sum of £3295.16 gross, subject to any deduction of tax and national insurance the respondent may be obliged to make.[5]The claimant’s claim for accrued and outstanding holiday pay pursuant to Regulation 14 of the Working Time Regulations 1998 is well-founded. The respondent is ordered to pay to the claimant the sum of £403.86 gross, subject to any deductions of tax and national insurance the respondent may be obliged to make.[6]Total award = £4372.10
