JUDGMENT
[1]The claimant’s complaint of failure to pay accrued holiday pay is well-founded and succeeds. The respondent is ordered to pay to the claimant the net amount of £446.55 in respect of unpaid holiday pay. Authorised by EMPLOYMENT JUDGE JOHNSONREASONS
[1]The Claimant’s whole claim is struck out under Rule 37 (1)(d) on the grounds that it has not been actively pursued. In particular the Claimant has failed either to acknowledge or respond to the Tribunal’s letters of 5 July 2022. 5 December 2022 or 15 December 2022. The letter of 15 December 2022 expressly said that the Tribunal is considering a Strike Out under Rule 37 (1) (d).
