Employment Tribunals Rules of Procedure 2013: Rule 21[1]The claimant was dismissed in breach of contract by a failure by the respondent to pay to the claimant for her period of notice. The respondent is ordered to pay damages to the claimant in the sum of £1,125.36.[2]The respondent has failed to pay the claimant’s accrued but untaken holiday pay upon termination of employment. The respondent is ordered to pay the claimant the gross sum of £500.60.[3]The respondent has failed to pay the claimant a statutory redundancy payment. The respondent is ordered to pay to the claimant the sum of £1,688.04.[4]The payments ordered at paragraphs 1, 2 and 3 above are made up as follows:a. Unpaid notice: 9 weeks’ notice: 12 hours per week x 9 weeks @ £10.42 per hour = £1,125.36.b. Unpaid holiday pay: 4 days accrued, untaken and unpaid holiday upon termination x 12 hours per day: 4 x 12 @ £10.42 per hour = £500.16.c. Unpaid statutory redundancy payment: 9 years @ 1.5 x £125.04 per week = £1,688.04.d. Total a + b = £3,313.56
