[1]The claimant’s claim of unfair dismissal was not presented to the employment tribunal within the period prescribed by section 111(2) of the Employment Rights Act 1996 (ERA) and it was reasonably practicable for the claim to be presented within the prescribed period. The tribunal therefore does not have jurisdiction to hear the claim, which is struck out in its entirety pursuant to Rule 37(1)(a) of Schedule 1 of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013 (“the 2013 Rules”).
