Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £1,553.75. a. The sum at 1 above has been calculated as follows: gross weekly wage of £750 divided by 60 hours per week is £12.50 per hour. 124.3 hours @ £12.50 = £1,553.75.

REASONS

[1]By a letter dated 21 December 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has no reasonable prospect of success.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
