JUDGMENT
[1]The claimant’s complaint of unauthorised deduction from wages is well-founded and succeeds. The respondent is ordered to pay to the claimant the sum of £4,421.27 in respect of wages unlawfully deducted. That is a gross amount and the claimant shall be responsible for the payment of any income tax and national insurance contributions thereon.REASONS
[1]This matter came before me this morning for consideration of the claimant’s claim of unauthorised deduction from wages. The claimant attended in person. There was no attendance or appearance on behalf of the respondent. The respondent has failed to submit a Response.[2]It became clear from discussions with the claimant, that she had entered into a contract of employment with Urban Candle Company Limited, that being the name on the document signed by Mr Matthew Patterson and given to the claimant on 2nd January 2019. I am satisfied that the proceedings should be amended to show the correct name of the respondent as Urban Candle Company Limited. I authorise the address on the tribunal file to be changed to the registered office of that company, namely 17 Sharpeton Drive, Great Park, Gosforth, Newcastle upon Case Number: 2502077/2019 Tyne NE3 5RL. The claimant told me today that the Gosforth address is the home address of the managing director Mr Matthew Patterson.[3]I consider it likely that these proceedings have already been brought to the attention of the respondent and Mr Patterson as they were served at the address from which the respondent’s products are manufactured. I see no prejudice to the respondent in making these amendments.[4]I accept the claimant’s evidence to what she should have been paid and that none of the monies due to her by way of wages have in fact been paid.
