[1]The time for presenting a response has expired and no valid response has been presented, and, on the information before the employment judge, the claims of unfair dismissal disability discrimination succeed. Employment Judge Shepherd _____________________________ Date: 18 July 2019[2]Case Number 2502063/19 1 THE EMPLOYMENT TRIBUNALS Claimant Respondent Mr D Lofthouse Pendragon Motor Group Ltd JUDGMENT on RECONSIDERATION without a hearing HELD AT NORTH SHIELDS ON 8 August 2019 EMPLOYMENT JUDGE Shepherd[4]I revoke my Judgment of 15th May 2018 because it is necessary in the interests of justice to do so and order the decision be taken again. I ORDER the name of the respondent be amended to that shown above and the remedy hearing listed for 14 August 2019 be converted to a case management preliminary hearing with a time estimate of 90 minutes. REASONS[5]I gave a judgment, on 18 July, on liability only under Rule 21 of the Employment Tribunal Rules of Procedure 2013 in circumstances where no response had been presented, upholding claims of unfair dismissal and disability discrimination. The respondent applied for a reconsideration on 24 July sending a draft response and explaining the failure to respond in time was due to an administrative error. By email on 6 August the claimant’s solicitor indicated he did not object. .
