The appeal is struck out.REASONS
[1]By a letter dated 5 March 2025 the Tribunal gave the appellant an opportunity to make representations or to request a hearing, as to why the appeal should not be struck out because:• the appellant had not complied with the Orders of the Tribunal to prepare and send to the respondent witness statements for those who are going to be witnesses at the final hearing (the appellant having stated it intends to rely on witness evidence at the hearing);• the appeal has not been actively pursued.[2]The appellant has failed to make representations in writing why this should not be done. Nor has the appellant asked to make such representations at a hearing, such as the final hearing scheduled to begin on 17 March 2025. The appeal is therefore struck out.[3]The hearing fixed for 17 to 20 March 2025 will not take place. Approved by:
