Employment Tribunals Rules of Procedure 2013: Rule 21[1]The claimant was dismissed in breach of contract by a failure by the respondent to pay to the claimant for his period of notice. The respondent is ordered to pay damages to the claimant in the sum of £205.92.[2]The respondent has failed to pay the claimant’s accrued but untaken holiday pay upon termination of employment. The respondent is ordered to pay the claimant the gross sum of £292.46.[3]The payments ordered at paragraphs 1 and 2 above are made up as follows:a. Unpaid notice: 1 week’s gross pay @ £205.92 per week.b. Unpaid holiday pay: 7.1 days accrued unpaid holiday x 7.6 hours per day @ £5.42 per hour = £292.46.
