JUDGMENT

The judgment of the Tribunal is as follows: Unfair Dismissal[1]The complaint of unfair dismissal under Part X Employment Rights Act 1996 is well-founded. The claimant was unfairly dismissed. The respondent is ordered to pay the claimant the following:a. A basic award in the sum of £1630.20.b. A compensatory award in the sum of £8100.48. i. The respondent unreasonably failed to comply with paragraphs 12 and 25 to 28 of the ACAS Code of Practice for Disciplinary and Grievance Procedures. Pursuant to section 207A of the Trade Union and Labour Relations (Consolidation) Act 1992 the compensatory award of £6750.40 is increased by the sum of Case No. 2501948/2024 £1350.08, being a 20% increase in the compensatory award. This increase is included in the sum at paragraph 2.b. above.[2]The recoupment regulations apply.a. The total monetary award for unfair dismissal is £9730.68, being the total of the basic and compensatory awards.b. The prescribed element is £5272.24.c. The prescribed period to which the prescribed element is attributable is between 23 July 2024 and 27 March 2025.d. The amount by which the monetary award for unfair dismissal exceeds the prescribed element is £4458.44.
