JUDGMENT
[1]The Claimant’s claim of:(a) unfair dismissal contrary to the Employment Rights Act 1996 is dismissed upon withdrawal, as the claimant did not have sufficient continuity of employment to present such a claim; and(b) breach of contract for a failure to pay notice pay is dismissed upon withdrawal, the notice pay having been paid.[2]By consent, contrary to Section 13 of the Employment Rights Act 1996 the Respondent has made unlawful deductions from the wages of the claimant in the sum of. £177.44 which sum has been paid by the Respondent.
