JUDGMENT

The claim is dismissed on withdrawal by the claimant

REASONS

[1]The Employment Tribunal Rules of Procedure 2013 ( the Rules) provide in Rules 51 and 52 where a claimant informs the Tribunal in the course of a hearing, that a claim, is withdrawn, the claim comes to an end, subject to any application the respondent may make for a costs order and , other than in two circumstances neither of which apply, the Tribunal shall issue a judgment dismissing it (which means the claimant may not commence a further claim against the respondent raising the same, or substantially the same, complaint). After the end of the claimant’s case, during a lunch break, she decided to withdraw. The respondent said it would not apply for a costs order. T M Garnon
