JUDGMENT

[1]The claimant’s complaint of unauthorised deduction from wages was not presented to the Employment Tribunal before the end of the period of 3 months beginning with the date of payment of wages from which the deduction was allegedly made. The Employment Tribunal is not satisfied that it was not reasonably practicable for the claim to have been presented within that 3 month time limit. The Employment Tribunal does not have jurisdiction to hear the complaint. The complaint is dismissed.[2]The respondent’s application for costs, made on the ground that the claim did not have any reasonable prospect of success, is refused.
