JUDGMENT
[1]The claimants’ complaints under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 that the respondent failed to comply with the requirements of section 188 or section 188A of the 1992 Act as to collective consultation are wellfounded and succeed;[2]The respondent is ordered to pay to each of the claimants by way of a protective award under section 189(3) of the 1992 Act remuneration for the period of 90 days beginning on 6 April 2023 (the date on which the first of the dismissals to which the complaints relate took effect).[3]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply to this award.
