ON APPLICATION FOR RECONSIDERATION The respondent’s application dated 14th February 2020 for a reconsideration of the Tribunal’s order dated 22nd January 2020 and promulgated on 4th February 2020, that the second respondent B be joined into these proceedings, is refused on the grounds that it has no reasonable prospect of success.REASONS
[1]By letter dated 14th February 2020, solicitors for the second respondent applied to the Employment Tribunal for a reconsideration of the decision made by myself on 22nd January 2020, to grant the claimant’s application to join in B as a second respondent in these proceedings.[2]The second respondent’s letter of 14th February sets out a summary of the reasons given for the decision to join in the second respondent and goes on to set out reasons why there should be a reconsideration of that decision, to the effect that it should be revoked.[3]Upon reading the reasons for the application for a reconsideration, I am satisfied that all of those reasons (and in particular the time point) were fully aired by Ms Besnard of counsel for the second respondent, at the hearing on 22nd January. The matters raised in the letter of 14th February were properly aired at the hearing on 22nd January, as is clear from the reasons given for the original decision.[4]In those circumstances, I am not satisfied that it is in the interests of justice for there to be a reconsideration of the original decision.
