JUDGMENT

[1]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £1710.00 (24 x £71.25p gross per week) and the respondent is ordered to pay that sum to the claimant.[2]The claim for non - payment of holiday pay advanced pursuant to Regulations 14 and 16 of the Working Time Regulations 1998 is well-founded. The respondent is ordered to pay to the claimant the sum of £29.69 unpaid holiday pay. This is a gross amount and the claimant is ordered to pay to the appropriate authorities any income tax due in respect of such sum on receipt by her. Case Number: 2501496/2017[3]The claim for wrongful dismissal (breach of contract) is well-founded and the respondent is ordered to pay to the claimant £852.60 (12 weeks at £71.05 per week net) damages for breach of contract (unpaid notice pay).[4]The respondent was in breach of his duty to the claimant under section 1(1) and/or section 4(1) of the Employment Rights Act 1996 when these proceedings were begun and there is an award to the claimant of two weeks’ pay in the sum of £142.50. The respondent is ordered to pay to the claimant the said sum of £142.50 pursuant to section 38(3) Employment Act 2002.[5]The total sum payable by the respondent to the claimant is £2734.79 and is payable forthwith.
