The claim is struck out in whole on the grounds it has no reasonable prospect of success and has not been actively pursued.

REASONS

[1]Following the claimant’s non-attendance at a preliminary hearing which I conducted on 11th December 2017, I sent a full explanatory note and made an order that by 4pm on 29th December the claimant either make written representations as to why his claim should not be struck out or apply for a hearing. He has done neither.[2]I approach this case on the assumption the claimant will be able to prove everything he alleges in his claim form. Even if he does, the legal obstacles to his succeeding seem insurmountable. Often litigants in person do not understand the law, so Employment Judges explain matters face to face or in writing. I did so and the claimant has not been able to suggest any way his case can succeed . TM Garnon
