[1]The claimant’s claim that the first respondent failed to comply with the requirements placed upon it under section 188 or of the Trade Union and Labour Relations (Consolidation) Act 1992 (‘TULRA’) is well founded.[2]The Tribunal orders the respondent by way of a protective award under section 189(3) TULRA to pay to the claimant a payment equivalent to remuneration for the period of 90 days beginning on 10 February 2023. Recoupment[3]The Employment Protection (Recoupment of Job Seekers Allowance and Income Support) Regulations 1996 applies. Regulation 6 imposes upon on the respondent a duty to provide information to the Secretary of State.
