Each of the claims listed in the Appendix are struck out as having no reasonable prospect of success.REASONS
[1]On 18th December I sent to the parties a list of claimant names and case numbers. On 17thAugust 2017 I had decided claimants who accepted a settlement through ACAS by signing a CoT3 in respect of alleged inequality of pay up to 31st December 2010 ended the claim numbers to which they related but were not prevented from issuing a fresh claim for subsequent periods. For the claimants it was accepted claims which were settled up to 30th September 2012 were, as Single Status was introduced by the Council with effect from 1st October 2012, ones where there was no ongoing inequality. I call this “the CoT3 issue”.[2]I have been attempting to ascertain which claims should now be struck out, as a result of the CoT3 issue.
