JUDGMENT

[1]In respect of her complaint of unfair dismissal, the respondent is ordered to pay to the claimant a basic award in the sum of £8,068.50 and a compensatory award in the sum of £28,600.[2]In respect of the claimant’s complaint of breach of contract (failure to pay notice pay) the respondent is ordered to pay to the claimant wages in lieu of notice in the sum of £5,215.54. This is a net amount and the respondent shall be responsible for the payment of any income tax and national insurance contributions thereon.[3]In respect of the claimant’s complaint of failure to provide a written statement of terms and conditions of employment, the respondent is ordered to pay compensation to the claimant in the sum of £1,956.[4]The claimant’s complaint of unlawful deduction from wages is well-founded and succeeds. The respondent is ordered to pay to the claimant the sum of £3,910 in Case Number: 2501211/2016 respect of wages unlawfully deducted. This is a gross amount and the claimant shall be responsible for the payment of any income and national insurance contributions thereon.[5]The claimant’s complaint of failure to pay accrued holiday pay is well-founded and succeeds. The respondent is ordered to pay to the claimant arrears of holiday pay in the sum of £340. This is a gross amount and the claimant shall be responsible for the payment of any income tax and national insurance contributions thereon.[6]The respondent is ordered to pay to the claimant the further sum of £1,200 by way of reimbursement of Employment Tribunal fees.
