The Judgment of the Employment Tribunal is as follows:[1]The Claimant’s claim for holiday pay is not well-founded and is dismissed.[2]The Claimant’s claim for notice pay is well founded. The Respondent is ordered to pay to the Claimant the sum of £2,160.00. This is a net award and the Respondent shall be liable to the Inland Revenue for any tax and national insurance payments thereon.[3]The claimant’s claim for a redundancy payment is well-founded. The Respondent must pay a redundancy payment to the Claimant in the sum of £5400.00.[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply.
