JUDGMENT

[1]The claimant’s claim that she is owed salary from the respondent in respect of the month of June 2017 (which she calculates to be a net sum of £5,481.64), whether that claim is brought as a contract claim or as a claim for non-payment of wages under Part II of the Employment Rights Act 1996, is not well-founded and is dismissed.[2]The claimant acted unreasonably in the bringing of the proceedings against the respondent and in the way she conducted the proceedings especially having seen the respondent’s response, and her claim against the respondent had no reasonable prospect of success and, accordingly, pursuant to Rule 76(1)(a) and (b) of the Employment Tribunals Rules of Procedure 2013 (and having had regard to her ability to pay), I order that she shall pay to the respondent the sum of £100 in respect of costs he incurred while legally represented.
