JUDGMENT

[1]The allegations that the respondent harassed the claimant contrary to the Equality Act 2010 by doing the following things are all struck out: 1.1. On or about 19 March 2021 someone, while on an online interview, asking the Claimant if she had told her boyfriend that she wanted him to take her knickers off while the Covid lockdown restrictions were still in place in Madrid. 1.2. On or about a date in September 2021, someone saying to the Claimant “have you had sex with your father?”. 1.3. On or about 8 February 2022, someone saying to the Claimant “have you masturbated the day before” and later “you are a frigid bitch”. 1.4. On or about the first week of April 2022, someone saying to another person, in the presence of the Claimant when they were discussing how the Claimant obtained her employment, “she has sucked his dick, that’s why she got the job”. 1.5. On or about the third week of April 2022, someone saying to another person “I would fuck you, but I am with this one”, with reference to the Claimant and that other person in the same conversation describing the Claimant as a “bitch”. 1.6. On or about May 2022 at the Pele Tower living room someone saying to the Claimant “you are going to regret that; I am going to fuck your boyfriend”. 1.7. At an online equality workshop in May 2022 someone referring to the Claimant as a “hag” and a “bitch”. 1.8. On 25 April 2022, on a boat journey, and in the presence of others, someone saying, “this cunt thinks I’m going to eat her pussy” and later telling a Billy Shield’s deck man “I am not going to apologise to a bitch”. 1.9. On or about 12 July 2022, when the Claimant mentioned to someone that she had been called a “cunt”, that person saying to another that restraining orders were issued for less than that and the other person saying “I am not going to lose my job for a bitch”. 1.10. At an end of season picnic at Longstone on 27 August 2022, someone saying in the presence of others to the Claimant “I hate you, you are a bitch” and another person shouting “Are we friends with The Bitch now?” while the Golden Gate Guests were waiting on a boat at Inner Farne jetty. 1.11. Between 20 and 29 March 2023, someone describing the Claimant as a “cunt”. 1.12. On or about 6 May 2023, someone, when the Claimant raised the issue of domestic abuse by another person, telling the Claimant that she didn’t “want to talk with a dyke” and then stating “the dog treats are there, help yourself”, as if the Claimant was a “bitch”. 1.13. On or about a date in July 2021, someone saying to the Claimant “I don’t think someone that is taking medication should use a brush cutter”. 1.14. On or about May 2022 at the Pele Tower living room someone saying, with reference to the Claimant “she is taking medication. I think that someone that is taking medication shouldn’t work in a (sic) an island”. 1.15. On or about the second or third week of June 2022, someone saying to a man known as “Erik” that the Claimant was a “drug addict”. 1.16. On or about the third week of June, someone shouting to the Claimant “I have found three boxes of Lorazepam in your luggage”. 1.17. On or about 30 November 2022, someone saying in relation to the Claimant “she has gained a lot of weight; she might have some binge eating problems as well”. 1.18. On or about May 2022, when the Claimant was in the kitchen discussing Spanish food and ingredients, someone telling her to put Spanish ingredients up her arse. 1.19. On or about 31 August 2022, someone, in the context of discussing pictures he’d seen of the Claimant’s parents, saying “well, you showed me those pictures and they were peasants”. 1.20. Someone telling the Claimant, when she enquired about applying for an area ranger post, that she was unlikely to secure the post because she did not have an English degree. .

REASONS

[2]Following a preliminary hearing held on 14 May 2025 the claimant was Ordered to pay deposits of £250 as a condition of continuing to advance each of the allegations of harassment referred to in the judgment above.[3]The Order was sent to the claimant on 17 September 2025. The deposits were required to be paid no later than 28 days from that date. The claimant has not paid any of the deposits.[4]For reasons set out elsewhere I do not accept the claimant’s submission that she has withdrawn all of the complaints of harassment.[5]Therefore, all of the allegations of harassment are required to be struck out under rule 40(4) of the Employment Tribunal Procedure Rules 2024.
