JUDGMENT
[1]This is the unanimous judgment of the Employment Tribunal.[2]The claimant’s complaint of unlawful discrimination arising from disability under section 15 of the Equality Act 2010 is well-founded and succeeds.[3]The claimant’s complaint of unfair dismissal within the Employment Rights Act 1996 is well-founded and succeeds.[4]The Employment Tribunal will decide the matter of remedy on 7 August 2025 at 10am with one day allowed. Approved by: S D Robertson REMEDY JUDGMENT[1]This is the unanimous judgment of the Employment Tribunal.[2]The respondent is ordered to pay to the claimant compensation for unlawful disability discrimination under the Equality Act 2020 in the sum of £9,373.75, made up of an award for injury to feelings of £8,500.00 plus interest of £873.75 (469 days at 8% per year)[3]The respondent is ordered to pay to the claimant compensation for unfair dismissal within the Employment Rights Act 1996 in the sum of £3,753.32, made up of a Basic Award of £3,253.32 and a Compensatory Award of £500.00 (for loss of statutory rights). The Recoupment Regulations do not apply to this award.
