ON LIABILITY AND REMEDY Employment Tribunals Rules of Procedure 2013 – Rule 21 The Judgment of the Employment Tribunal is as follows:[1]The claimant’s claim for the unauthorised deduction of wages pursuant to section 13 of the Employment Rights Act 1996 is well-founded and succeeds.[2]The respondent is ordered to pay to the claimant gross wages in the sum of £480.77, subject to any statutory deduction the respondent may be obliged to make.[3]The claimant’s claim for notice pay is well-founded and succeeds.[4]The respondent is ordered to pay to the claimant notice pay in the sum of £480.77 gross, subject to any statutory deductions the respondent may be obliged to make.[5]The claimant’s claim for accrued and outstanding holiday pay pursuant to Regulation 14 of the Working Time Regulations 1998 is well-founded and succeeds.[6]The respondent is ordered to pay to the claimant gross holiday pay in the sum of £279.32, subject to any statutory deductions the respondent may be obliged to make.[7]Total award = £1240.86REASONS
[1]The Claimant made an application to the Employment Tribunal on 17 May 2023 claiming for unpaid wages from 28 February to 5 March 2023 in the sum of £480.77 gross, notice pay from 6 March to 13 March 2023 in the sum of £480.77 gross and holiday pay in the sum of £279.32 gross. After reservice on the correct address for the respondent, the respondent was required to file a response by 23 August 2023. The respondent has failed to file a response.[2]The above Judgement has been entered on the basis of the information provided by the claimant on the ET1 form.
