[1]The judgment is revoked. The respondent’s response was presented to the Tribunal within the applicable time limits. It was overlooked, due to an administrative error. The response form contains an arguable defence to the claim. It is plainly necessary in the interests of justice to revoke the judgment and consider the matter again. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[2]The claimant’s claim for unauthorised deductions from wages succeeds. The respondent must pay the claimant £1200 gross. The hearing listed on 10 July 2023 is cancelled.
