JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the wages of the claimant. The respondent is ordered to pay to the claimant £250.00p in respect of unpaid wages.[2]The respondent is ordered to pay to the claimant £1390.83p net damages for breach of contract (unpaid notice pay).[3]The total sum payable by the respondent to the claimant is £1640.83p and is payable forthwith.[4]If the claimant wishes to claim costs from the respondent application should be made in accordance with the provisions of Rules 74-84 of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. A hearing may be necessary.[5]The hearing scheduled to take place on 2 July 2018 at Teesside Justice Centre Middlesbrough is vacated.

REASONS

[1]The claimant filed a claim with the Tribunal on 12 April 2018 which was served on the respondent on 1 May 2018.[2]The respondent has failed to file a response to the claim.[3]The claimant has provided written information to the Tribunal which satisfies me that the above mentioned sums are due to him in respect of the claims advanced to the Tribunal.
