Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant presented a claim to the Employment Tribunal for unpaid holiday pay on 3 August 2017.[2]Notice of the claim was sent to the respondent on 4 August 2017. A response was required by 1 September 2017. A response has been presented by the respondent out of time on 6 September 2017. In that response the respondent has indicated that it does not defend the claim for unpaid holiday pay. The response is not accepted as it is out of time.[3]This claim succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing.[4]The hearing listed on 2 October 2017 is converted to a Remedy Hearing. The venue and length of hearing remain the same.
