The claim is struck out.REASONS
[1]The claimant failed to attend the hearing on 9th August 2022. A call made to the claimant’s telephone number that day, was terminated when the clerk from the Tribunal identified himself.[2]The claimant was sent an order requiring him to explain why he did not attend the hearing and why he did not inform the respondent and the Employment Tribunal that he did not intend to attend the hearing and furthermore, he was warned that if he did not comply with the order, or adequately comply with the order, his claim may be struck out for failure to comply with an Employment Tribunal order, or failing to actively pursue his claim. He was required to respond by 16th August 2022.[3]By 2nd September 2022, the claimant had not responded at all to the order of the Employment Tribunal.[4]His claim is therefore struck out for failing to comply with the Employment Tribunal order and/or failing to actively pursue his claim.
