JUDGMENT

The Claimant’s complaint of disability discrimination is struck out on the basis that it has no reasonable prospects of success under Rule 37 of the Employment Tribunals Rules of Procedure 2013.

REASONS

By an ET1 dated 12 May 2022 the Claimant made a complaint of disability discrimination asserting the discriminatory act complained of was his dismissal. In a Case Management Hearing on 25 July 2022, the Claimant conceded his dismissal was not related to his alleged disability. By Case Management Orders dated 27 July 2022 the Tribunal ordered the Claimant to make representations as to why his complaint of disability discrimination should not be struck out because it has no reasonable prospect of success. The Claimant failed to comply with the Case Management Orders and a Public Preliminary Hearing was listed to determine whether to strike out all of or any part of the complaint of disability discrimination on grounds that it has no reasonable prospect of success. On 8 December 2022 the Claimant requested a Postponement of the hearing which was rejected on 9 December 2022. The Claimant failed to attend the hearing of 14 December 2022, or to make sufficient, or any, representations in writing as to why his complaints should not be struck out. The 10.2 Judgment - rule 61 February 2018 Case No: 2500619/2022 Claimant’s complaint of disability discrimination is therefore struck out on the grounds that it has no reasonable prospect of success.
