JUDGMENT

[1]Pursuant to Rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, the claimant’s complaint of unfair dismissal is wellfounded and succeeds. The respondent is ordered to pay to the claimant compensation for unfair dismissal in the sum of £1,325.00.

REASONS

[1]By a claim form presented on 29th March 2021, the claimant brought a complaint of unfair dismissal against the respondent.[2]The claimant in her claim form set out that she had been employed by the respondent from 13th August 2015 until she was dismissed on 7th January 2021.[3]The claim form was served upon the respondent on 26th May 2021, together with a copy of the response form ET3 and instructions to the respondent to complete and return that response form to the tribunal office by not later than 23rd June 2021.[4]By 23rd June 2021, the respondent had failed to complete and return the response form ET3.[5]The claimant has set out a calculation of a basic award, based upon her age and length of service in the sum of £1,325.00. The claimant has confirmed that she obtained alternative employment the day following her resignation. Case Number: 2500423/2021[6]The tribunal is satisfied on the information before it that the claimant was unfairly constructively dismissed and is entitled to a basic award in the sum of £1,325.00.
