Miss K Connon v Cumbria, Northumberland, Tyne and Wear NHS Foundation Trust: 2500282/2022
JUDGMENT
The claim is struck out.REASONS
[1]By an Order sent to the parties on 27 July 2022, the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claimant has not complied with the Orders of the Tribunal and the claim has not been actively pursued. In particular, the claimant:• Has not adequately complied with the Tribunal’s Order dated 18 May 2022 to provide details of any (and every) provisions, criteria or practices that she says were applied to her in connection with her claim of indirect sex discrimination.• Has not complied with the Tribunal’s Order dated 18 May 2022 to disclose documents relevant to the issues identified for the Preliminary Hearing of 25 July 2022, by 22 June 2022.• Has not complied with the Tribunal’s direction dated 18 May 2022 to liaise with the respondent about the preparation of an agreed bundle of documents.• Has not complied with the Tribunal’s Order dated 18 May 2022 to provide a witness statement by 15 July 2022.• Has not replied to the Tribunal’s letter dated 15 July 2022 requiring her to provide comments by return on the respondent's email of 5 July.• Did not attend the Preliminary Hearing listed on 25 July 2022 at 9:45am or make any contact with the Tribunal to explain her absence.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
