JUDGMENT

[1]The claimant’s claim for a protective award under section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 (“TULRA”) is well-founded and succeeds.[2]The Tribunal makes a declaration under section 189(2) TULRA that the Respondent has failed to comply with its duty to consult appropriate representatives in accordance with section 188 TULRA.[3]The Tribunal determines that the protected period under section 189 (4) TULRA is 90 days.[4]The respondent shall pay to the claim the sum of £8,838.00 (representing 90 days’ gross pay at a daily rate of £98.20). _____________________________ Employment Judge Loy Date: 13 September 2021 .
