JUDGMENT

The Judgment of the Employment Tribunal is as follows:[1]The correct title of the respondent is amended to JMF Print Limited and services deemed to have been effected.[2]The claimant’s claim for the unauthorised deduction of wages contrary to section 13 of the Employment Rights Act 1996 is well-founded and the respondent is ordered to pay to the claimant the sum of £1987.87. This is a gross award and the claimant shall be liable to the Inland Revenue for any tax and national insurance deductions thereon.[3]The claimant’s claim against the respondent for breach of contract is wellfounded and the respondent is ordered to pay to the claimant the sum of £190.08. This is a net award and the respondent shall be liable to the Inland Revenue for any tax and national insurance deductions thereon.[4]The respondent was afforded the opportunity to contact its legal adviser about presenting a claim of breach of contract to the County Court against the claimant prior to continuing with today’s hearing, however the respondent refused twice to take this opportunity and was adamant that he wished to continue with today’s hearing.[5]Total award = £2,177.95 EMPLOYMENT JUDGE ARULLENDRAN
