Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the North East Employment Tribunals on 17 January 2023. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £4577.02 gross.[3]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £792.15.[4]The respondent having failed to comply with the ACAS code of practice in respect of the claimants guidance about his unpaid wages, the Tribunal is satisfied that there should be an uplift of 10% in respect of the sum owed to the claimant in the sum of £536.92.[5]The respondent having failed to provide the claimant with a written statement of his terms and conditions of employment, the respondent is ordered to pay compensation to the claimant in the sum of £1056.24.[6]The respondent must pay the claimant £6962.33 in total.[7]The hearing listed on 24 March 2023 is cancelled.
