Miss B Clarke v HMRC: 2500024/2025

EMPLOYMENT TRIBUNALS
Case No 2500024/2025
Miss B ClarkeClaimantHMRCRespondent
Employment Judge SweeneyDate 15 December 2025

JUDGMENT

The claim is struck out.

REASONS

[1]The Tribunal wrote to the claimant on 8 August 2025 warning them that the Tribunal was considering striking out the claim. This was because it appeared to the Tribunal, applying Rule 38 of the Employment Tribunal Procedure Rules 2024, that the claimant had not complied with the Order of the Tribunal dated 22 May, sent to the parties on 13 June 2025 and specifically orders 4, 5, 6 and 14. the claim had not been actively pursued in that she failed to attend private preliminary hearing listed for 22 May 2025 and 8 August 2025 without good reason and has failed to respond to the Tribunal’s further correspondence and Orders.[2]I am satisfied that the grounds for striking out the claim under Rule 38 apply, and that it would be in accordance with the overriding objective in Rule 3 to strike out the claim.[3]The claim is therefore struck out.
