JUDGMENT

[1]The title of the respondent in these proceedings is amended to Sigma Technical Plastics Limited (in creditors voluntary liquidation) in order to reflect its proper corporate name.[2]The complaints of breach of contract and of unlawful deductions from pay in relation to holiday pay are dismissed. The Tribunal does not have jurisdiction to determine them because they were presented outside the period of three months from the date on which time started to run, even allowing for the effect of early conciliation, when it was reasonably practicable for them to have been presented within time.[3]The complaint in relation to a statutory redundancy payment under section 163 Employment Rights Act 1996 succeeds and the claimant is entitled to be paid a redundancy payment in the sum of £1,098.44.
