JUDGMENT

[1]The complaint of unfair dismissal in each case is dismissed following a withdrawal by each of the claimants.[2]The claimants’ remaining claims will proceed to hearing on 28 November 2018. _____________________________ Employment Judge Franey 9 October 2018[1]All claims against the first respondent are dismissed and it is removed from the proceedings as there is no limited company of that name.[2]All claims against the second respondent are dismissed and it is removed from the proceedings because it was not the employer of the claimant.[3]The third respondent was the employer of the claimant.[4]The claimant is permitted to amend the claim so as to pursue a complaint of breach of contract in relation to notice pay.[5]The complaint of unlawful deductions from pay in relation to payment for accrued but untaken annual leave succeeds and the third respondent is ordered to pay the claimant the gross sum of £326.19 unlawfully deducted from pay. Case No. 2424458/2017 2[6]The complaint of breach of contract succeeds and the third respondent is ordered to pay the claimant the net sum of £200.00 representing one week’s net earnings.[7]The total amount payable by the third respondent to the claimant is £526.19.
