JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the claimant's wages for the period between February and June 2017 and is ordered to pay the claimant the gross sum of £2,297.27.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1,500.00 equivalent to four weeks’ pay.[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £665.14 representing 10.2 days of accrued but untaken annual leave.[4]The hearing listed on 9 February 2018 is cancelled. Employment Judge Franey 24 January 2018[1]The respondent breached the claimant’s contract of employment and made an unauthorised deduction from her wages by failing to pay to her that amount that was properly payable to her in respect of notice pay.[2]The respondent made a further unauthorised deduction from wages and breached regulation 30 of the Working Time Regulations by failing to pay to the claimant the amount that was properly payable to her in respect of compensation for untaken annual leave under regulation 14 of the Working Time Regulations upon termination of her employment.[3]The respondent further breached the claimant's contract of employment by failing to pay her by reference to an agreed salary of £17,500 per annum. Case No. 2424260/2017 2[4]The respondent did not, however, breach the claimant’s contract of employment by failing to pay her in respect of time she did not work.[5]The claimant is to notify the Tribunal by 21 August 2018 if a further hearing is required to determine remedies in respect of the above.
