JUDGMENT

The claimant’s complaint of age discrimination is struck out. His complaint of unfair dismissal will proceed to a hearing.

REASONS

[1]By an order sent to the claimant on 9 February 2018 he was ordered to pay a deposit of £500 as a condition pursuing his complaint age discrimination following a preliminary hearing held on 31 January 2018.[2]The claimant has failed to pay this deposit. The complaint of age discrimination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[3]For the avoidance of doubt, the claimant’s complaint of unfair dismissal may proceed to a hearing.
