JUDGMENT
[1]The claimant's claims that the respondent has failed to pay him holiday pay to which he was entitled at the end of his employment and that it breached his contract with regard to the payment of expenses with regard to car parking fees and/or fines are dismissed. The Tribunal does not have jurisdiction as these matters were already adjudicated upon under case number 2404733/2012 by Employment Judge Hewitt in his judgment of 13 September 2012 sent to the parties on 27 September 2012.[2]The claimant's claims of disability discrimination (discrimination arising from disability and a failure to make reasonable adjustments) presented to the Tribunal on 15 November 2017 relating to the claimant's employment (which terminated on 30 November 2011) and subsequent post termination litigation in August 2016 (at Burnley County Court):(1) Are dismissed as having been presented out of time in circumstances when it would not be just and equitable to extend time to 15 November 2017, and in any event(2) Had no reasonable prospect of success and would have been dismissed in any event.
