JUDGMENT

The judgment of the Tribunal is that the claimant’s claim is dismissed.

REASONS

The hearing was adjourned part-heard on 8 January 2018 for the respondent to disclose further information and documents to the claimant. The respondent did so, providing an additional bundle of some 39 pages and a supplementary witness statement from its witness, Ms K Wood, HR Manager. The claimant did not attend the adjourned hearing and no explanation for his absence or written representation was received from him, in circumstances where he still had to conclude his evidence and the respondent was yet to give evidence. Since the burden of establishing his claim of unlawful deduction from wages and the extent of such deduction or non- payment fell on the claimant, his claim was dismissed upon the application of the respondent.
