JUDGMENT

[1]The Respondent unlawfully deducted the sum of £122.75 from the wages of the Claimant and the Respondent is ordered to pay the Claimant the sum of £122.75.[2]The Tribunal considers that the response had no reasonable prospects of success for the purpose of rule 76 of the Employment Tribunal Rules of Procedure, and that a time preparation order of eight hours at an hourly rate of £36 should be made under rule 79, amounting to £288. The Respondent is ordered to pay the sum of £288 to the Claimant in respect of the preparation time he spent working on the case. The total sum due to the Claimant is, therefore, £410.75.
