JUDGMENT

The claim is struck out.

REASONS

[1]The respondent company went into administration in March 2018 and then into creditors voluntary liquidation in March 2019. Neither the consent of the Administrator nor the permission of the court was obtained for the proceedings to be continued during the administration as required by the Insolvency Act 1986.[2]The claimant has not replied to the Tribunal’s letters dated 28 February 2019 and 22 March 2019. In particular, on 22 March 2019 the Tribunal gave the claimant an opportunity to apply for a lifting of the stay on proceedings put into effect during the administration, warning him that if he did not reply his claim would be struck out as it had not been actively pursued. The claimant again failed to reply.[3]The claim is therefore struck out as the claimant has failed to pursue it.
